Patent Search
The request from our customer was to get a complete overview of all relevant technology areas affecting their product. Additionally, all competing patents were to be identified in order to prevent patent infringements.

Problem:
The customer planned in-house fabrication of a product which was until then provided by one single supplier. On the side of the supplier, there was a big risk of not fulfilling the requirements of the customer and thus threatening insolvency.
At the same time, the customer saw great potential in the possibilities of optimizing the properties of the product through its own focused developments, offering possibilities of increased efficiency and profit margins.
Result:
The patent search was conducted at an early stage of the project. It was seen that the supplier had applied for a patent but neglected to pay the maintenance fee. Thus, it was possible for the customer to make a completely new development of the product and finally to patent the improved version themselves.
Patent Monitoring
Our customer wished to have an overview of the current developments of competitor companies as well as the present trends in the industry and on the market.

Problem:
Within the regular technology monitoring a competitor patent was found which could potentially jeopardize the production of a new product being developed by the customer.
Result:
Lapp Engineering AG made an analysis of the patentability of the pending competitor patent application. At the same time, a patent search was conducted in order to find documents that could help dispute against the validity of the competitor patent. In addition, the whole patent family was observed and monitored.
Since the patent examiners did not find any relevant documents during the verification of the competitor patent, Lapp Engineering AG submitted an anonymous document which was then taken into account in the examination. The result was a limited protection of the competitor patent, leaving the new development of the customer out of reach.
